Some Basic Problems in Revising of the Labor Security Supervision Regulation
Abstract: The labor security supervision regulation which has been implemented for more than nine years, exposed many problems. After the issuing of“labor contract law”，“labor dispute mediation and arbitration law”and the other laws, parts of the regulation exposed conflicts with the two laws, the revision of the“labor contract law”in 2013 increased the labor inspection regulation on labor dispatch business. A few parts of the regulation seriously can't adapt to the needs of practice, we should completely revise it as soon as possible. To adapt to the need of the law and the situation, the labor inspection should accurately lo cate the inspection function, expand the applicable objects, reasonably define the boundaries of labor dispute and the labor inspection, standardize the procedures of administrative punishment and administrative punishment, give appropriate law enforcement means and measures to the labor inspection department, set up the qualifications of labor inspector.
